Notes:
Trademarks are indicators of origin or source. If the mark applies to a good it is called a trademark. If it applies to a service it is called a service mark.
Trademarks protect against a likelihood of confusion as to the source of a particular good or service.
Independent adoption is not a defense to trademark infringement
Rights are enforceable in court by suit or by bringing charges if the infringement is willful.
